- Drink Driving Sentencing Severe: Report
Sentences for high range drink driving offences in NSW have become more consistently severe according to the results of a study released by the Judicial Commission of NSW. The Commission’s study examined the impact of the guideline judgment on high range prescribed concentration of alcohol (PCA) offences issued by the Supreme Court in September last year at the request of the Attorney General. 2005 (168Kb)
- The impact of increased drink-driving penalties on recidivism rates in NSW
This bulletin examines the implementation and deterrent effect of legislation that increased the statutory penalties for drink-driving offences in NSW in 1998. Comparisons of drink-drivers sentenced before and after the legislative amendments reveal a significant reduction in reoffending after penalties were increased. May 2004
- Sentencing drink-drivers: The use of dismissals and conditional discharges
This study shows that (in NSW) the use of dismissals and conditional discharges for PCA offences has increased sharply over the last ten years, across each of the three PCA offence ranges. The rate of use of dismissals and conditional discharges in relation to PCA offences, however, varies markedly across Local Courts. February 2004
- Sentencing high-range PCA drink-drivers in NSW
BOCSAR report of a study which shows that, for offenders convicted of high-range prescribed concentration of alcohol (PCA) offences over the five years to June 2001, almost one-quarter were repeat drink drivers. Of these repeat offenders, more than half had a prior PCA conviction in the high range. The sentencing of high-range drink drivers is examined in relation to the frequency and nature of prior drink-driving convictions, and to the presence of concurrent driving convictions. Alcohol Interlock Implementation in the European Union: Feasibility Study A Breath Alcohol Ignition Interlock Device (BAIID) is a breath testing device connected to the ignition system of a motor vehicle. It prevents an operator from starting the vehicle if the breath alcohol concentration exceeds a predetermined threshold. From November 2000 until September 2001, a consortium of European road safety research institutes conducted a feasibility study regarding the implementation of BAIIDs in EU drink-driving policies. This is the final report of the feasibility study. (pdf file)
